Grandparents Rights Regarding Adoption


Many birth mothers and birth fathers do not know that their parents have rights as grandparents.  In some states grandparents have rights even if their grandchild is being placed for adoption.

Grandparent Rights

In many states grandparents, both on the biological mother's and biological father's side of the family, have legal rights related to their grandchild even if the child is being placed for adoption. These rights may include more than just visitation.  In an adoption, if the birth mother is a minor or the grandparent has been the primary caregiver to the child, the grandparent may have adoption rights and rights regarding notification. A review of the child adoption laws of your state may help answer questions you have about grandparents' rights in a child adoption.

Support for Grandparents

Grandparents Rights Organization is a national volunteer nonprofit organization whose purpose is to educate and support grandparents and grandchildren and to advocate their desire to continue the grandparent-grandchild relationship, which may be threatened by the death or divorce of the parents.

AARP's Foundation for Grandparenting  is dedicated to raising grandparent consciousness to better the lives of grandchildren, parents and grandparents through education, research, programs, communication, and networking.

American Association of Retired Persons website helps spell out the rights of a grandparent in a child adoption.

National Committee of Grandparents for Children's Rights was established to form a coalition of concerned grandparents, citizens and agencies united to create one voice and to network with groups throughout the nation.  They advocate and lobby for legislative changes that protect the rights of grandparents to secure their grandchildren's health, happiness and well-being.
